AK Newsletter is a web application that:

• Operates public newsletter subscription pages with double opt-in confirmation
• Provides an admin area for companies and employees to manage subscribers
• Offers a template editor with image uploads for creating email newsletters
• Supports scheduled and immediate email dispatch via SMTP
• Enables subscriber import/export (CSV/XLSX) and subscriber lifecycle management

3. Usage rights

3.1

Use of the public subscription page is free of charge and without registration. Access to the admin area requires an employee account created by a company administrator.

3.2 You may use the platform for

• Legitimate newsletter marketing in the name of the contracted company
• Information purposes and subscriber communication in accordance with consent obtained
• Internal company administration of newsletter operations

3.3 The following is not permitted

• Subscription of third-party email addresses without explicit, verifiable consent
• Sending of spam, unlawful, misleading or infringing content
• Misuse or overloading of the platform
• Automated bulk operations (scraping, brute force, mass imports without authorization)
• Resale, sublicensing or provision of the platform to unaffiliated third parties
• Use of the platform for illegal purposes or circumvention of rate limits and security measures

4. Content and liability

4.1 Responsibility for newsletter content

Each company and its authorized employees are solely responsible for the content of the newsletters they create and dispatch, including compliance with advertising law, competition law, copyright and consent requirements.

4.2 Uploaded media and subscriber data

Uploaded images, templates and subscriber lists are stored and processed exclusively for the operating company. Employees and operators must ensure they have the necessary rights to use images and contact email addresses.

4.3 Copyright and consent

Operators are responsible for ensuring that they are allowed to use any uploaded content and that email addresses have been collected in compliance with applicable data protection law (GDPR / UWG / TMG etc.).

5. Disclaimer

The platform is provided "as is". We do not assume any warranty for:

• Timeliness, accuracy, or completeness of content
• Availability of the platform
• Damages resulting from use of the platform

5.2 Liability for external content

Operators of the referenced third-party servers are responsible for the content made available at those URLs.

6. Changes

We may change these terms at any time. The current version is available on the website.

7. Governing law

These terms are governed by the laws of the Federal Republic of Germany.
